Cancellation Policy

Definition of Consumer
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.

Important Notice Regarding Customized Products

Please note that according to Section 312g(2)(1) of the German Civil Code (BGB), the right of withdrawal does not apply. The artworks sold via our online shop, particularly custom-made portrait drawings, are tailored to the individual needs of the consumer and are not pre-made.

Right of Withdrawal

You have the right to cancel this contract within 30 days without providing any reason. The cancellation period is 30 days from the date you or a third party designated by you (other than the carrier) takes possession of the goods. Pre-made items, such as frames, art prints, or posters (without personalization), can be returned.

Exceptions
As per Section 312g(2)(1) BGB, the right of withdrawal does not apply to contracts for goods that are not pre-made and are produced based on the consumer’s individual selection or specification or clearly tailored to personal needs, such as personalized products, hand-drawn portraits, or oil paintings. Therefore, contracts for these products generally do not include a right of withdrawal.

Exercising Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to cancel this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send your communication regarding the exercise of the right of withdrawal before the cancellation period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the date we receive your cancellation notice.

We will use the same payment method you used for the original transaction unless explicitly agreed otherwise. You will not incur any fees for this refund. If you requested that services commence during the withdrawal period, you must pay us an appropriate amount corresponding to the services provided until the time you notified us of your withdrawal.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for:

  • Goods that are not pre-made and require individual specifications or personalization by the consumer (§ 312g(2)(1) BGB).
  • Goods that are perishable or have a short expiration date.
  • Alcoholic beverages agreed upon at the time of contract but delivered at least 30 days later, and whose value depends on market fluctuations beyond the trader’s control.
  • Newspapers, magazines, or periodicals, except for subscription contracts.

The right of withdrawal expires early for:

  • Sealed goods that are unsuitable for return for health or hygiene reasons once unsealed.
  • Goods inseparably mixed with other items due to their nature after delivery.
  • Sealed audio or video recordings or computer software if unsealed after delivery.
